These terms and conditions outline the rules and regulations for the use of the Plany Nationwide Limited website and the subscription agreement terms and conditions, under the domain https://plany.co.uk

By accessing and using this website you accept these terms and conditions in full. Do not continue to use the Plany Nationwide Limited website if you do not accept all the terms and conditions on this page.

Interpretations

The definitions and rules of interpretation in this clause apply in these Terms and Conditions:

Additional Terms: The additional terms and conditions (if any) agreed to by the Licensor and Licensee as set out or referred to in the Order Form including any addendum thereto.
Affiliate: The agreement between the Licensor and the Licensee, such agreement being embodied in the Order Form, these Terms and Conditions and any Additional Terms.
Agreement: The agreement between the Licensor and the Licensee, such agreement being embodied in the Order Form, these Terms and Conditions and any Additional Terms.
Authorised Use: Use of the Service in accordance with the Agreement.
Intellectual Property Rights:   All copyright, database rights, patents, trade marks, service marks, and all other intellectual property rights whether registered or unregistered and all applications and rights to apply for the registration of any of the rights above and all other forms of protection of a similar nature or having equivalent or similar effect to any of these which may subsist anywhere in the world.
Licensee: The organisation, firm, company or other entity to whom the license in respect of the Service is granted by the Licensor under the terms of this Agreement and whose details are set out on the Order Form.
Licensor: Plany Nationwide Limited of 78 Shenley Road, Borehamwood, Hertfordshire, WD6 1EH also known as Plany and Licensor.
Materials: Data and reports relating to the Plany.co.uk functionality within the service provided.
Order Form: The online registration form and any associated pages and communications used to sign up for the Service identifying the Licensee whereby in any case the Licensee's acceptance has been signified by acceptance of these Terms and Conditions during the email verification and account activation process.
Subscriber: A User who has registered to use the Service under the terms of a Subscription. Such Users' access to the Service's features is provisioned in accordance with their Subscription Level.
Subscription: A purchase and agreement made by a Subscriber to receive and be given access to paid-for Services at a particular Subscription Level.
Subscription Fee: The licence fee payable by a Subscriber for use of the Service as set out on the Order Form and payable by the Licensee to the Licensor for their Subscription.
Subscription Level: The Subscription Level denotes the level of access a User has as a Subscriber to different combinations of tools and benefits, with higher subscription levels allowing Users greater access to product features and geographic coverage.
Subscription Renewal Fee: The licence fee payable by a Subscriber to the Licensor for continued use of the Service.
Subscription Period: The contractual period of time over which a Subscription runs, commencing on activation of the Licensee's User account and each anniversary thereof. Although this is typically one year, it may be longer subject to what the Licensee agreed to on the Order Form.
You /Your: The person signing up to and agreeing to these Terms and Conditions on behalf of and representing the Licensee, and therefore by association is interchangeable with a Licensee.
Your Data: All electronic data or information or documents submitted by You to the Service. These will be treated strictly as confidential.
User(s): The person or persons specifically identified to Plany as the named User of the Service on behalf of the Licensee.

Clause headings shall not affect the interpretation of this agreement. Words in the singular shall include the plural and vice versa. Any obligations in this agreement to not do something includes an undertaking not to permit that thing to be done. These Terms and Conditions shall take precedence over any terms or conditions that the licensee purports to apply in conflict with these Terms and Conditions herein, whether the Licensee’s terms are contained in Licensee’s purchase orders, supplier’s agreement, or otherwise.

Subscription and Payment

Your subscription contracts begins as soon as your order is processed, and payment is made by you and received by Plany Nationwide Limited. The subscription price will be made clear to you on our sign-up page or order form and may vary from time to time. The price shown on the Sign-Up page or order form and paid by you upon sign up will be paid in conjunction with the stated payment schedule on the order. This may be monthly, quarterly, semi annually or annually.

This Agreement constitutes a legal contract between the organisation (Licensee), as identified on the Sign-Up page or Order Form in the case of a Subscriber and the Licensor (hereinafter 'Plany’) that governs the Licensee's use of Plany Subscription service available at https://plany.co.uk

Upon commencement of a subscription, Plany as Licensor grants the licensee the right to have one named User (Identified by an email address that specifically identifies the user) per subscription of the service unless the Licensee’s subscription explicitly allows multiple users for the licensee’s organisation.

Subscriptions cannot be shared or used by more than one user license; users may be transferable within the same organisation at the express agreement with Plany.

You are responsible for all usage or activity on the service. Distribution of your password to others for access to the service is expressly prohibited and shall constitute a breach of these terms.

You agree to pay the fees at the rates notified to you at the time you purchase your subscription and in conjunction with the scheduled payment terms on the order form or signup page. We will always tell you in advance of any increase in the price of your subscription and offer you an opportunity to cancel it if you do not wish to pay the new price. Payments will automatically be taken by Plany Nationwide Limited in conjunction with the payment frequency agreement without notice. You authorise us to automatically charge your payment method(s) in conjunction with the payment frequency agreement during the subscription period. We will automatically charge you the then-current rate for your plan, plus applicable taxes (such as VAT as the rate does not include it, Plany’s VAT number 382 3482 85), until you cancel.

Your subscription contractual length is determined between Plany Nationwide Limited and Yourself. This may vary from time to time. The length of Your subscription contract is shown in the profile area of your account in Plany.co.uk and is confirmed on the order confirmation form emailed to you upon account activation and Plany receiving the first payment. The email address on the order confirmation form is sent to is the same email address the account is set up under. If the order confirmation form contains an error or the contract length stated in the order confirmation form is wrong please inform us within 14 days of payment being first received and we will change it. Once 14 days have passed the details on the order confirmation form are binding.

We will offer you an opportunity to break your subscription on the two-month anniversary of the contract start date if you are not happy with the service or have decided the service is not beneficial to you and your company.

Should You fail to make payment within 14 days of the subscription start, or throughout your term, or the renewal date, Plany Nationwide Limited reserve the right to suspend the service until payment of the undisputed amount is made. This does not remove the entitlement for Plany to pursue for the full balance due. The period of suspension of service will not be added to the subscription term or refunded.

Free trials

When you are offered a free trial to use the software, you will enter your bank details and set up your account in the normal way. No monies will be taken until the free trial has expired. Your first months rental will be taken on the day your free trials ends. If you decide the software isn’t for you please send us an email (hello@plany.co.uk) prior to the expiry day of the free trail and we will stop any payment coming out and delete your account details together with your banking details. Your free trail will end on the same day you send us the email.

Cookies

We employ the use of cookies. By using Plany Nationwide Limited website you consent to the use of all and any cookies in accordance with Plany’s privacy policy. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate / advertising partners may also use cookies. By using the Service and/or by accepting these Terms and Conditions the Licensee also accepts Plany’s privacy policy. Plany’s privacy policy can be found here.

Licence

Unless otherwise stated, Plany Nationwide Limited and/or its licensors own the intellectual property rights for all material on Plany. All intellectual property rights are reserved. You may view and/or print pages from https://plany.co.uk for your own personal use subject to restrictions set in these terms and conditions. The licence purchased by the Company’s Clients is for their purpose only and shall not be shared with any other party other than the client and their respective(s).

You must not:

  • Republish material from https://plany.co.uk
  • Sell, rent or sub-licence material from https://plany.co.uk
  • Reproduce, duplicate or copy material from https://plany.co.uk
  • Redistribute content from Plany Nationwide Limited (unless content is specifically made for redistribution).

The license that Plany Nationwide Limited sells to the client grants access to the system. The license grants use of the system in the intended manner. This solely includes the use by a human and excludes tools like scrapers, bots and algorithms using or pulling information or data from the plany.co.uk site.

Iframes

Without prior approval and express written permission, you may not create frames around our Web pages or use other techniques that alter in any way the visual presentation or appearance of our Website.

Cancellation Policy and Renewals

You may notify us of your wish to cancel your subscription by contacting our Customer Care team, Customer Success Team or the Business Development Representative managing your subscription and account. Please email us at hello@plany.co.uk with the following: “I/We hereby give notice that I/we cancel my/our subscription”.

Please then include:

  • The subscriber’s full name (person on the billing information if different from the user)
  • The Account email address
  • The billing address or delivery address (Including postcode)
  • Your contact telephone number

In order for us to cancel a subscription we must be notified at least 14 days prior to the contract expiry date or as per the 2-month anniversary break.

In the event that this is not done, the contract will automatically renew, and payment will be taken from you at the same frequency and price as the subscription. Upon renewal of a contract, a contract renewal confirmation order form will be emailed to the account holders email address. This will state the terms of the renewed subscription and contract. After the date of renewal and collection of payment by Plany Nationwide Limited, the client has 14 days to notify Plany to cancel the subscription. If nothing objecting to the renewed subscription is received by Plany from the client within the first 14 days of the renewed subscription, then Plany is entitled to approve the renewal of the contract and billing will continue. If the client objects to the renewal of the subscription after the renewal date, but before the 14-day period (as mentioned above), and once payment has been processed by Plany, then the subscription will end at the date of the next billing due date. Plany will not process a refund for payments that have been processed. The 2-month anniversary break does not apply to any renewal period.

What we promise

Plany Nationwide Limited promises to develop and operate https://plany.co.uk with reasonable skill and care and will use reasonable efforts to promptly remedy any faults of which it is aware. Plany endeavours to make the service available 24 hours a day during the Licensee’s subscription period. However, Plany will not be liable if for any reason the service is not available at any particular time or any unreasonable period.

What we do not promise

Plany Nationwide Limited does not provide any other promises or warranties about https://plany.co.uk and the Plany content. https://plany.co.uk and the Plany content are provided on an “as is” and “as available” basis. This means that Plany does not make any promises in respect of https://plany.co.uk or the services and functions available on or through https://plany.co.uk or of the quality, completeness or accuracy of the information published on or linked to from https://plany.co.uk other than as expressly stated above.

Plany Nationwide Limited will not be liable for any delay in performing or failure to perform its obligations under this Licence due to any cause outside Plany reasonable control. Such delay or failure shall not constitute a breach of this Licence and the time for performance of the affected obligation shall be extended by such period as is reasonable.

The above disclaimers apply equally to your use of https://plany.co.uk and all Plany Nationwide Limited. Without limiting the above, Plany is not liable for matters beyond its reasonable control.

Neither Plany Nationwide Limited nor its licensors shall be liable for any indirect, special, consequential loss, loss of profits, loss of revenue, loss of business, loss of use, loss of contracts, loss of anticipated savings or for any indirect economic or financial loss whatsoever and howsoever suffered, even if Plany has been advised of the possibility of such damages. Nothing in this Licence shall exclude or limit Plany Nationwide Limited liability for death or personal injury or any other liability that cannot be lawfully excluded under any applicable law.

Plany Nationwide Limited does not control third party communications networks (including your internet service provider), the internet, acts of god or the acts of third parties. Plany does also not warranty nor certify the content of the data or information contained on https://plany.co.uk website. This is third party data and may contain errors or omissions.

Please note that these details published on Plany’s website are for the purposes of planning and building control matters only. Use of applicants’ details without filtering constitutes an offence under the regulations of the Adverting Standards Authority and can result in penalties.

General
You may not license or transfer any of your rights under these terms and conditions. We may transfer any of our rights or obligations under these terms and conditions to any company but if we do so we will ensure that any company to whom we transfer our rights or obligations will continue to honour your rights under them.

If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which will remain in full force and effect.

Failure by either party to exercise any right or remedy under these terms and conditions does not constitute a waiver of that right or remedy. Headings in these terms and conditions are for convenience only and will have no legal meaning or effect.

These terms and conditions constitute the entire agreement between you and Plany Nationwide Limited relating to your use of the https://plany.co.uk website, Plany Nationwide Limited mobile and other online and offline services. They supersede all previous communications, representations, and arrangements, either written or oral.

https://plany.co.uk is best viewed with one of our supported browsers. These include (1) Google Chrome, (2) Safari, (3) Firefox. Any payment information you send to us over the Internet is encrypted and stored via Stripe at stripe.com. SSL is currently the preferred method to securely transfer credit card data over the Internet.

Choice of Law and Jurisdiction

If you are a user whose principal address or principal use of http://plany.co.uk occurs in the jurisdiction of the United Kingdom, then these terms and conditions will be subject to English law. In this case, to the extent possible in the applicable jurisdiction, both you and we agree that the courts of England will (subject to the final paragraph in this Section) have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and conditions.

Disclaimer

Plany Nationwide Limited do not warrant, represent, or offer any undertakings in respect of the content of the website (including but not limited to quality, accuracy, completeness, or fitness for a particular purpose of the information contained therein) and do not accept responsibility for loss occasioned because of reliance on the said information. For the avoidance of doubt, this disclaimer extends to the content of any third-party website accessed through hypertext links via https://plany.co.uk

Unless stated to the contrary, material in this website is subject to copywrite to Plany Nationwide Limited. Reproduction is limited to the downloading to a local hard disk for your personal use. The content of the website may not be copied or otherwise incorporated into or stored in any other website, electronic retrieval system, publication or other work in any form.

Data Protection Act

Your personal data is protected in the UK by the Data Protection Act. This provides amongst other things that the data we hold about you should be processed lawfully and fairly. It should be accurate, relevant, and not excessive. The information should, where necessary, be kept up to date and not retained for longer than is necessary. It should be kept securely to prevent unauthorised access by other people. You have the right to see what is held about you and correct any inaccuracies.

Plany Nationwide Limited may hold other details about you, particularly if you have a subscription or user account, which was applied for via phone, post or electronically.
